Terms of Service

These Terms of Service ("Terms") govern your use of InSync, a coaching management platform operated by TMDigital Studio Ltd ("we", "us", "our"). By creating an account, you agree to these Terms. Please read them carefully.

1. Who Can Use InSync

InSync is designed exclusively for independent personal trainers and fitness coaches who manage clients on a professional basis. By registering, you confirm that:

  • You are using InSync in a professional or business capacity, not as a consumer.
  • You are at least 18 years old.
  • You are legally permitted to operate as a personal trainer or fitness professional in your jurisdiction.
  • The information you provide during registration is accurate and up to date.

2. What InSync Provides

InSync gives you access to:

  • A web-based coach portal for managing clients, programmes, workouts, and nutrition.
  • A branded mobile app your clients can download to view their training and log progress.
  • Tools for scheduling, tracking, and communicating with clients.

We reserve the right to update, modify, or discontinue features at any time. We will give reasonable notice of significant changes where possible.

3. Acceptable Use

When using InSync, you agree that you will not:

  • Use the platform for any illegal purpose or in violation of any applicable laws.
  • Share your login credentials with others or allow multiple people to access a single account.
  • Upload or transmit malicious software, spam, or any content designed to harm others.
  • Attempt to access systems, data, or accounts you are not authorised to access.
  • Resell, sublicense, or commercially exploit the platform without our written permission.
  • Use the platform to store or process data that belongs to clients without a lawful basis for doing so.

You are solely responsible for the content you upload, the clients you manage, and how you use the platform with your clients. InSync is a tool — the coaching relationship is yours.

4. Your Responsibilities as a PT

As the personal trainer using InSync, you are responsible for:

  • Obtaining any necessary consents from your clients before entering their personal data into InSync.
  • Ensuring the health and fitness advice you provide is appropriate and within your professional competence.
  • Complying with UK GDPR and any other applicable data protection laws in your use of client data.
  • Keeping your own account credentials secure.

5. Subscriptions and Billing

Access to InSync is provided on a subscription basis. Pricing, billing cycles, and payment terms are described on the billing page within your account settings. Subscriptions renew automatically unless cancelled before the renewal date. We reserve the right to update pricing with reasonable notice.

6. Account Suspension and Termination

We reserve the right to suspend or terminate your account if:

  • You breach these Terms in a material way.
  • You fail to pay fees owed to us.
  • We believe continued access poses a risk to other users, clients, or the integrity of the platform.
  • We are required to do so by law.

Where possible, we will notify you before taking action and give you an opportunity to resolve the issue. You may also close your account at any time by contacting us at support@insynctrainer.com.

7. Intellectual Property

InSync and all software, design, and content within it are owned by TMDigital Studio Ltd or our licensors. Nothing in these Terms grants you ownership of any part of the platform. The data you enter — including your client records and programme content — remains yours.

8. Limitation of Liability

InSync is a software tool to help you manage your coaching business. To the fullest extent permitted by law:

  • We are not responsible for the outcomes of any fitness, health, or nutrition advice you give your clients.
  • We are not liable for any indirect, incidental, or consequential losses arising from your use of the platform.
  • Our total liability to you in any 12-month period is limited to the fees you have paid us during that period.
  • We do not guarantee uninterrupted or error-free access to InSync, though we will make reasonable efforts to maintain the service.

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

9. Changes to These Terms

We may update these Terms from time to time to reflect changes to the service, the law, or our business. When we do, we will update the date at the top of this page. For material changes, we will notify you by email with reasonable notice before the new terms take effect. Continuing to use InSync after that date means you accept the updated Terms.

10. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these Terms or your use of InSync shall be subject to the exclusive jurisdiction of the courts of England and Wales.
